Man faces DWI in fatal New York accident

On Behalf of | Sep 8, 2019 | DWI

Most every driver in New York has had a moment when their tires momentarily leave the road. While this is often innocuous, it can cause some drivers to panic and overcorrect. However, depending on the time of day and age of the driver, police may be quick to assume that an accident that follows such a scenario is related to DWI.

Unfortunately, police have accused a 26-year-old male driver of causing a fatal accident while he was intoxicated. The incident reportedly happened just after 6:30 a.m. on a day in late August. According to reports, the driver’s vehicle went off the road at an intersection. His vehicle then, police say, crossed a “median/pedestrian area” in the center of the road.

The vehicle reportedly struck a 57-year-old female pedestrian in the median. The woman was transported to the hospital but later passed away. The driver was also treated for minor injuries before he was taken into custody,

He was then booked on DWI charges in connection to the fatal accident. Despite the accusations against him, it is unclear why police suspect that drugs were a factor in the collision or what his blood alcohol content was at the time of the collision. In all cases involving criminal charges, those accused are presumed to be innocent; in order for them to be convicted, there must be sufficient evidence to prove guilt beyond a reasonable doubt — a standard that is often difficult for prosecutors in New York and across the country to meet. An experienced criminal defense attorney can help the man carefully examine the evidence in the case and create a plan of action that is most appropriate to his individual circumstances.
