New York traffic stop results in DWI charge

There are a variety of different reasons why someone would be driving during the early morning hours. Despite this, it may be easy for law enforcement officers to assume that those driving during the time period are under the influence of alcohol. For example, it is unclear what led a New York sheriff to suspect a driver was under the influence of alcohol resulting in the man's arrest and a DWI charge.

The incident happened just before 2 a.m. on a day in early January. According to reports, the deputy involved in the arrest was assigned to a STOP DWI unit. He reportedly pulled over vehicle driven by a 25-year-old man due to a traffic violation.

After pulling the man over, the deputy reportedly suspected that the driver was under the influence of alcohol. Reports indicate that the deputy then performed a field sobriety test and took the driver into custody. The driver, according to law enforcement officers, refused a breath test and had prior alcohol related convictions. 

In addition to a DWI charge, the New York man also faces charges related to driving on a revoked license and driving without an ignition interlock device; he was later released on his own recognizance after being arraigned. Despite these allegations, details regarding what violation led to the traffic stop or what let the deputy to believe that the man was under the influence are unclear. Because of this and the fact that the interpretation of field sobriety tests can be highly subjective, the driver may want an experienced criminal defense attorney to carefully examine the details of his case, especially the events leading up to his arrest.
